CV Axle snapped @ 8k miles

I was backing out of a parking space when the left front axle snapped. Toyota claims normal wear and tear; and will not cover it under warranty.
Looking for assistance, in fighting back with Toyota, or Navy terms "I need a Sea Lawyer " (I have escalated my claim).
I have dash cam footage of the event, I was pulling out of a sand parking spot when the driver's axle snapped damaging the crankcase.
$5k for repairs, on a truck with under 8k miles.
I must admit I was tired of hearing about transmission and other problems over the last six months of ownership. Well, here I am. FML

 

factory suspension and tires? you told them you were backing out of "Sand" parking spot?

 

That would only be "normal wear and tear" under ABNORMAL driving circumstances.

We know just enough, to not be able to make a fair judgement.

Is the truck lifted or modified?
And how the truck was being "backed" out of the sand parking spot might help.
Were you "semi-stuck" and giving it hell while backing out?

 

I have dashcam video, I slowly backed out. The dealer claims a normal wear-and-tear item. They were not concerned with upgraded suspension and tires.

 

80k on a Long travel kit and the CVs, never had an issue other then boots cracking, never had one "pop out" like that and push my truck. Especially just back out of a parking slot.

Were you in four-wheel-drive? I can’t see it happening in 2 Wheel Dr. But then again I don’t understand why somebody would back out of a parking space in four-wheel-drive.

 

That inner joint can just slide apart, doesn't look snapped to me.

Is that a factory shock? Looks like it over-extended.

thats bullshit, hows it not covered by powertrain warranty?

I'd take it to another dealer, or call whatever that corporate number is to see if you can start a case.

 

So 4wd with the steering wheel cranked all the way to the right.......

As someone who has had his wife not realize the truck was in 4wd and proceed to drive it all over town... is it really that easy??

I would think not. I am not trying to shit on the OP here but we really do not have much details on tire size, lift type, or what he has done in his sport for the previous 7999 miles. Just a video that I would think most of us would agree does not look like enough to cause it to break.

 

Yeah, without seeing how the truck sits, I can only assume it might have 3.5+ inches of lift maxing out the CVs.
